RESULTS FOR OUR CLIENTS
All of our clients have suffered life changing injuries or the death of a loved one. At Silverstein & Bast we work to provide compassionate yet zealous legal representation. We work as a team with our clients; as a result, we have been very successful over the last two decades in resolving cases as quickly and safely as possible.
In 2011 we settled the case of a 42 year old wife and mother for $4,000,000. The woman had an incidental finding on an MRI showing a brain tumor, but the hospital did not tell the patient. Tragically, the tumor grew until it caused seizures. Two brain surgeries and radiation were required, and there is a risk that the tumor may recur.
In 2010, we settled a wrongful death claim for $1,890,000 for the family of a mother who died of complications following bariatric (stomach stapling) surgery.
Also in 2010 we settled a birth injury case for $3,500,000. The child suffered a stroke at birth when the physicians used both a forceps and a vacuum extractor to deliver her.
In 2009, we obtained a jury verdict for $24,100,000 in favor of our client, a 16 year old girl who suffered injuries at birth. We proved that the injuries were due to the failure of the hospital to keep the mother at bedrest, leading to premature delivery and birth. This verdict was widely reported as one of the top 100 verdicts nationwide.
In 2008 we obtained $2.5 million for an infant who contracted HIV due to the failure of the medical clinic to test the mother. The mother in that case also received a settlement of $610,000.
Also in 2008 we obtained a settlement of $1,023,941 for an 11 year old boy, who suffered multiple fractures when a building façade collapsed.
In 2007, we obtained settlements for three children in the amount of $4.5 million, $1.7 million and $1.2 million. We also obtained a settlement for $1.7 million for the family of a woman who died of a drug overdose at a hospital.
In 2006 we settled for $1.75 million the case of a man paralyzed because a hospital did not perform spinal surgery in time.
In January 3, 2005 we collected $1,425,000 for a woman who suffered a ruptured brain aneurysm due to a radiologist’s misreading of a CT scan.
On June 27, 2005 we collected $1,825,000 for a child injured as a result of an inappropriate vacuum extraction delivery at birth.
On March 8, 2004 we obtained a settlement of $1,300,000 for an 80 year old woman who suffered partial paralysis following surgery at a well-known Manhattan hospital. We believe this to be the largest settlement of its kind for an elderly patient.
In 2003 we won a $6.1 million dollar verdict in favor of the family of a 34 year old woman who died of a pulmonary embolism following a cesarean section. The case had been declined by another firm before the family came to us.
Other notable successes included a verdict of $550,000 against a State Hospital for failing to properly treat lung cancer; a verdict for $2.5 million against a neurosurgeon for improperly performed back surgery; a $580,000 settlement for a construction worker whose foot was run over by a forklift and a $587,500 recovery for an 82 year old woman who suffered an eye injury tripping on a staircase.
